Legal Aid Lawyer in Toronto: What Happens After Your Certificate Is Approved

The approval notice from Legal Aid Ontario (LAO) usually brings a wave of relief, and then a fresh set of questions. Who do you contact first? Will anyone send you a bill? What if the lawyer you had in mind turns you down? Getting the certificate is only half the job, and the next steps determine how quickly a legal aid lawyer in Toronto can start working on your criminal case.

Think of the certificate as a payment guarantee. It covers a private lawyer’s work on your case for a set number of hours; LAO pays that lawyer directly, and you pay nothing to the lawyer who accepts it. The catch, if you want to call it one, is that the certificate does nothing until a legal aid lawyer in Toronto formally accepts it.

Getting Your Certificate to a Legal Aid Lawyer in Toronto

How the certificate reaches a lawyer depends on what you did when you applied. LAO notifies a named lawyer electronically. If you left that part blank, you can find your certificate number in your client portal account and pass it to the lawyer yourself.

  • If you named a lawyer, follow up with their office to confirm they received the notice.
  • If you named nobody, have your certificate number ready before your first call.

Not every defence lawyer takes certificates, and some accept them only for certain courthouse locations. Ask about this in the first conversation, before you share your case details.

The Acknowledgement Window and Why Timing Matters

A lawyer has 30 days to acknowledge or decline your certificate. After that, LAO prompts you to find someone else, and a certificate nobody acknowledges expires 90 days after it was issued.

Here is why that matters. If you wait a few weeks before contacting anyone, you leave yourself less time to find a replacement if the first lawyer says no. A lawyer might decline for ordinary reasons, such as a full calendar or a conflict with another client.

Changing Your Legal Aid Lawyer in Toronto After Acceptance

Choose carefully, because switching later is not simple. Once a lawyer accepts your certificate, you need LAO’s permission to change. Staff look at your reasons, how much work the lawyer has already billed, and how many change requests you have made before.

Many people meet only one lawyer before deciding. A second short call with another lawyer might save trouble later, though that can feel like a luxury with a court date coming up.

Keeping Your Legal Aid Certificate Active Until Your Case Ends

Approval is not permanent. Let’s break it down:

  • Finances: The consent and declaration form you sign lets LAO check your financial information to confirm you remain eligible. If you stop qualifying, LAO can cancel the certificate and send a notice of Intention to Cancel to you and your lawyer.
  • Time limits: A certificate ends three years after it was issued, and your lawyer must request any extension at least 60 days before that date.

The next steps are fairly plain. Keep your portal login handy, confirm your lawyer’s acceptance in writing, and answer any LAO request for documents quickly. Would a missed letter from LAO put your defence on hold at the worst possible moment? Probably not, if you stay on top of it.
